Dallas Personal Injury Claim Lawyers Balance Scales Of Justice

The personal injury claim lawyers at Frenkel & Frenkel have several weapons in their legal arsenal that they believe tip the scales of justice in favor of their clients; the latest computer and 3D animation technologies, access to top accident reconstruction specialists, and contacts with well-respected doctors to help juries understand complex medical issues. There’s even an M.D. on the staff of attorneys at the Dallas-based law firm.

But they work in a city that routinely gets football-crazy between September and January, so it makes sense to use a sports analogy to describe one of the best advantages Frenkel & Frenkel brings to the courtroom table for clients – the firm’s founders, brothers Mark and Scott Frenkel, have peeked into the oppositions playbook.

“You have to understand that I started out, as did my brother, working for the defense side,” Scott Frenkel said. “So I had my training representing doctors, hospitals and large corporations.”

That experience helped drive the brothers to form their own law firm in 1994, and it guides them as they prepare their clients - individuals hurt due to negligence – for the rigors of what can be a long, exhausting process seeking justice against large, deep-pocketed defendants. “One of the things that we wanted to do, and I know it sounds cliché, but we wanted to fight for, quote, ‘the little guy’ because it takes a lot of resources to go up against these companies, these doctors, these hospitals, these nursing homes and their attorneys,” Scott said. “It’s almost impossible for someone to bring about a medical malpractice case by themselves. There are a litany of procedural traps.”

The Frenkel law firm is determined, however, to level the playing field for their clients and their families, who are dealing with the effects of injuries or deaths caused by drunken driving, defective auto parts, workplace accidents, medical malpractice, or pharmaceutical mistakes. Individuals or their families seek justice through avenues such as nursing home abuse lawsuits, but that often pits them against large corporations with teams of lawyers and unlimited resources.

“We do it every day,” Mark Frenkel said. “We’re taking on billion-dollar corporations, Ivy League lawyers, and stables full of lawyers with unlimited funds. We’ve got to match them financially, and then we have to match them technically, and then we have to match them with our manpower, and we can do all that.”

Frenkel & Frenkel’s success with achieving victories for clients in a birth injury lawsuit or a prescription drug lawsuit has won the firm recognition from peers and the press. The brothers have been listed in D Magazine’s “Best Of” issue (voted on by other area attorneys) and Mark Frenkel has been invited to speak at Texas Trial Lawyers Association events. The personal injury claim lawyers recently won a $1.7 million verdict for a client, and that success was chronicled by ABC investigative reporter Brian Ross during a “Nightline” segment.

The highest acclaim, however, seems to come from an unlikely source, says Mark: “The other thing to look for – who refers us cases. A lot of times, it’s the same defense lawyers we’ve beat in court, and they’ll send us their friends and family because we do a great job.”

Yet despite the success and the courtroom victories, Mark Frenkel says the suffering of clients as they pursue some measure of closure in a courtroom helps to keep everything in perspective. That attitude points to yet another advantage that he believes sets his firm apart from the rest – the ability to keep the “personal” in personal injury by never losing sight of the human being that sits with him at the plaintiff’s table.

“You cannot divorce yourself emotionally from your case,” he said. “That’s what these cases are about, and there may be a tendency after doing this almost 20 years to become hardened, but we don’t and we draw on our own personal lives, things that have happened to us. When we are attending a client’s funeral, when we’re representing a family that’s lost a loved one, when we’re visiting them in the hospital, all along the way, we’re there for the family both as counselors and as attorneys.”

Scott Frankel adds that a successful quality for personal injury claims lawyers involves being upfront with the client as to what legal fights like physician malpractice lawsuits may involve. “You know, our titles are attorneys and counselors. I take the counselor part of that very seriously,” Scott said. “At the onset we give them (clients) a roadmap of what to expect, because litigation is no fun. They know what our job is, they know what their job is. We work hand in hand with our clients, and so it really is a team effort.”

The firm’s partners make sure they are available for clients 24 hours a day, 7 days a week. “We always have been, because our client’s problems aren’t 9-to-5,” Mark said. “If you’ve lost a loved one, if you’re at home in a wheelchair because an 18-wheeler ran you off the road or a drunk driver hit you, we’re going to be there for you. Whatever it takes, 24-7, we’re your lawyers.”
